Legal Battle Ensues: Court Halts Arrest Of APC Ward Officers Behind Ganduje’s Suspension

In a recent legal development, the suspension of Umar Ganduje, former governor of Kano State and current national chairman of the All Progressives Congress (APC), has sparked controversy and legal actions within the party. Ganduje was suspended by the executive of two factions of his ward in Dawakin-Tofa Local Government for alleged involvement in the misappropriation of public funds and other criminal issues during his tenure as governor of Kano.

A Kano high court has intervened in the matter, granting an ex parte order that restrains law enforcement agencies and party officials from arresting or harassing the APC ward officers responsible for Ganduje's suspension. The court order, issued by Justice Yusuf Ubale Muhammad, specifically restrains the Inspector General of Police (IGP), Assistant Inspector General (AIG) Zone 1 Kano, and Commissioner of Police Kano from taking any action against the ward officers. Additionally, the order extends to the APC National Working Committee (NWC), State Council of the party, and APC acting National Chairman, Dr. Abdullahi Ganduje, preventing them from using security operatives to arrest or detain the Ganduje ward executives.

The legal action was initiated through a consolidated ex parte motion filed by Jafar Adamu and 10 others, as well as Haladu Gwanjo and Laminu Sani Barguma, who lead the factional ward officers. Their counsel, Shamsu Ubale Jibrin, argued for the protection of their fundamental human rights as guaranteed by the constitution. The court order, dated April 29, 2024, and based on affidavits sworn by the applicants, serves as a temporary injunction until the hearing and determination of the motion on notice, scheduled for June 5, 2024.

The suspension of Umar Ganduje by the two factions of the Ganduje ward stems from allegations of financial misconduct and criminal activities during his tenure as governor. Despite facing legal challenges from within the party, attempts to arrest the ward officers responsible for the suspension have been met with legal resistance. The involvement of security agencies, including the police and the Department of State Security (DSS), has escalated tensions within the APC in Kano State.

The legal battle surrounding Ganduje's suspension highlights the complexities of intra-party politics and the role of the judiciary in resolving internal disputes. It also underscores the importance of upholding due process and respecting the rights of party members, even in the face of allegations of wrongdoing. As the case unfolds, stakeholders are closely watching the legal proceedings and their implications for the future of the APC in Kano State.

Beyond the immediate legal ramifications, the dispute over Ganduje's suspension raises broader questions about accountability, transparency, and governance within political parties. The allegations against Ganduje underscore the need for robust mechanisms to prevent corruption and hold public officials accountable for their actions. By addressing issues of financial misconduct and criminal behavior, political parties can uphold integrity and regain public trust.

Moreover, the involvement of law enforcement agencies in the internal affairs of political parties raises concerns about the politicization of security institutions. The directive to arrest the ward officers reflects the influence of party leaders over state institutions and underscores the need for impartiality and independence in law enforcement. Upholding the rule of law and respecting judicial decisions is essential for safeguarding democracy and protecting individual rights.

In conclusion, the legal battle surrounding the suspension of Umar Ganduje by APC ward officers in Kano State highlights the challenges of intra-party politics and the importance of legal recourse in resolving internal disputes. The court order halting the arrest of the ward officers underscores the role of the judiciary in upholding the rule of law and protecting individual rights. As the case continues to unfold, it serves as a reminder of the need for accountability, transparency, and integrity in governance, both within political parties and in public office.
